Terms of use

Introduction

By using the services (“Site”) provided by Openapi, ownership of Openapi S.r.l. (“Openapi”), based in Viale Marinetti 221, Roma, VAT no. 12485671007, the user (“User”) must comply with the following terms of use (“Terms of Use”).
Access to the Site and any action that results in navigation on its web pages constitute full acceptance of the Terms of Use which are available at the foot of each page of the Site.

Openapi reserves the right to change, modify, add or remove portions of these Terms of Use at any time and without giving prior notice. The User is responsible for checking periodically these Terms of Use before any use of the Site, in order to take account of any changes and align its behaviour with the current Terms of Use. It is the User's responsibility to periodically check for any changes in laws, regulations and guidelines relevant to the Site that might have occurred after its first use.

The User is also responsible to read the “Privacy Policy” and the “Cookie Statement”, expressly provided to interested parties in accordance with the procedures and methods required by law and available at any time through links accessible at the bottom of each page of the Site, before providing any personal data.

About the Site

The Site is intended to provide commercial information and digital services through APIs. Browsing as an unregistered User is limited to specific public pages. In order to be able to use the services provided through the Site, the User shall agree with the Terms of Use of the service.

Copyright (Industrial and intellectual property)

All site content - including text, database, graphics, user interfaces, trademarks, logos, icons, images and media files - is owned by Openapi, either is specifically licensed for what concerns its use and disclosure to third parties; the content mentioned above is protected by current regulations relating to industrial and intellectual property.

In particular, the right of economic use of all services provided are owned by Openapi and/ or third parties who have specifically authorised Openapi to publish, subject to the ownership of the moral rights of the respective authors.

Any use, for any purpose, of the content of the Site is prohibited, if it isn't expressly authorised or not in accordance with these Terms of Use. Users who intend to publish or otherwise reuse part of the content of the Site can make appropriate requests by writing to openapi@legalmail.it.

The content of the Site can not be reused for any purpose, until obtaining written consent from Openapi. In consenting the use of contents, Openapi may impose specific restrictions, as well as the use of a particular disclaimer.

Linking and Framing

It is not allowed, without prior written authorisation from Openapi, to engage and submit the content of the Site within another website, thus placing a so-called "framing". In this regard, Openapi reports that the breach of what stated above integrates the extremes of a conduct that can be pursued according to the current rules in force.

Openapi reports that the Site may contain some links to third party websites. The mentioned links are intended to be provided for information purposes only, in order to make the browsing easier to the Users or for any other purpose which could be strictly related to the service provided by the Site. Openapi assumes no responsibility for the accuracy or the update of the information contained in the website accessed through web links; it is the User's responsibility to check the adequacy of the consulted information through these links.

Openapi makes no representation or warranty regarding third party websites and their content and can not be held liable for the correctness of the information contained.

Use of the Service

The User undertakes to make diligent use of the Site. In particular, each User agrees not to:

  • alter, violate, disable or destroy the protections on the Site or test their vulnerability;
  • interfere in any way with the navigation on the Site or with the enjoyment of services by other Users thus placing, for example, attempts to overload the system or installing viruses;
  • access the services from a platform other than that made available by Openapi;
  • use the Site for purposes other than benefiting from its services;
  • gain/attempt to gain unauthorised access to any other User account.

Exclusion of liability (Disclaimer)

Given the public or publicly accessible source of information contained in the Site and provided via API, Openapi makes no representation or warranty regarding their correctness and completeness. Therefore the User acknowledges and agrees that such information may not be used as the sole or predominant basis for its business, commercial, financial, economic and/or credit decisions, which remain of exclusive responsibility of the User.

The User makes use of the services provided by his own choice and on the basis of these Terms of Use. Independently of the professionalism with which it provides the content available on the Site, Openapi is not liable for any damages, losses and/or costs, whether direct, indirect, incidental, special or consequential, and any charges that Users and/or third parties may incur resulting from reliance placed upon the content of documents and information displayed, and/or in consequence of their possible inaccuracy.

Openapi informs it may at any time in complete autonomy and at its own discretion change, add, modify and/or supplement the Site and/or its content, as well as the technology used. Openapi explicitly states that, as a result of such operations, it may occur a temporary impossibility to access the Site and/or its content.

In that regard, Openapi assumes no responsibility for any malfunctions or shortcomings involving the technology used for building and publishing the Site pages. This applies in particular to what concerns the smoothness of data transmission, as well as the functionality of the server hosting the Site pages.

Supported Browser and Software

The website, the data exchange interface (Openapi API) and the services provided are supported by all major operating systems and web browsers.

It is the User's responsibility to install any software/ hardware and perform any technical intervention needed to ensure current and future functionality of the Site and the API provided to every User.

Openapi is not liable in the event that the tools used by the User do not allow access to the services provided.

Language

The Terms of Use are provided in Italian and English language.

Governing Law

The Terms of Use shall be governed solely by Italian law, according to which any dispute is to be resolved.
